These Terms & Conditions (“Terms”) govern your access to and use of the ConvertQuiz application and related materials available at convertquiz.app (collectively, “ConvertQuiz”, the “Service”). ConvertQuiz is owned and operated by Ewa Poplawska NIP: 5791555954 Olszewskiego 17, 80-234 Gdansk, Poland (“Company”, “we”, “us”, or “our”). By accessing or using ConvertQuiz, installing or pushing the snapshot/assets into a GoHighLevel (“GHL”) sub-account, or clicking “I agree,” you agree to these Terms. If you do not agree, do not use the Service.

1. The Service & Relationship with GHL

1.1 Plugin. ConvertQuiz is a plugin/extension that enhances native GHL quiz functionality. It requires an active GHL account controlled by you or your agency.

1.2 Independent provider. We are not affiliated with, endorsed by, or responsible for GHL. Your use of GHL is subject to GHL’s own terms and privacy policy.

1.3 Updates & compatibility. We may update ConvertQuiz (including hosted scripts) to maintain compatibility with GHL. We strive for continuity, but temporary interruptions or degraded performance may occur due to changes made by GHL or third-party services.

2. Eligibility; Accounts

2.1 You must have legal authority to bind the entity on whose behalf you use ConvertQuiz.

2.2 You are responsible for your GHL environment, configuration, custom fields/values, automations, and user permissions.

3. Licenses & Intellectual Property

3.1 License. Subject to these Terms and timely payment of all fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use ConvertQuiz within your selected GHL sub-account(s), solely for your internal business purposes.

3.2 Restrictions. You shall not (and shall not allow others to): reverse engineer, decompile, modify core code, remove notices, resell outside permitted GHL Marketplace flows, or create derivative works of the Service.

3.3 Ownership. ConvertQuiz (including code, templates, text, design, and documentation) is owned by us. No rights are granted except as expressly stated.

4. Fees, Taxes, & No-Refund Policy

4.1 Pricing. Fees may be one-time and/or per-sub-account, as shown in the GHL Marketplace at checkout. Agencies may optionally resell per Marketplace rules.

4.2 Taxes. Fees are exclusive of taxes; you are responsible for all applicable taxes, duties, and withholdings.

4.3 No refunds; waiver of right of withdrawal. All sales are final. No refunds. By purchasing digital content that is delivered immediately (snapshot/assets/hosted scripts), you expressly consent to immediate performance and acknowledge you lose any statutory right of withdrawal/refund to the maximum extent permitted by applicable law. If mandatory law requires a refund in specific circumstances, those provisions will prevail.

5. Support & Changes

5.1 Support. We provide commercially reasonable email support for installation and configuration guidance related to ConvertQuiz (not GHL itself).

5.2 Changes. We may add, change, or discontinue features at any time. Material changes will be reflected in the “Last updated” date.

6. Your Responsibilities

6.1 Content & compliance. You are solely responsible for: (a) your quiz content, questions, answers, categories, forms, automations, and redirect destinations; (b) accuracy and legality of data you collect; and (c) compliance with all laws (e.g., privacy, marketing, consumer protection, e-commerce, and accessibility).

6.2 Third-party terms. You must maintain your GHL subscription and comply with GHL policies.

7. Data Protection

7.1 Roles. For website visitors to convertquiz.app, we act as controller (see Privacy Policy). For end-customer data you collect through GHL using ConvertQuiz, you (or your agency) are the controller and we act as a processor/sub-processor limited to providing the Service.

7.2 DPA. If required by law or your organization, we will provide a Data Processing Addendum upon request.

8. Disclaimers

8.1 As-is. ConvertQuiz is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

8.2 No guarantees. We do not guarantee uninterrupted or error-free operation, specific conversion results, or permanent compatibility with any specific GHL version or third-party tool.

9. Limitation of Liability

9.1 Exclusions. To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, goodwill, data, or business interruption; or platform/provider outages (including GHL or hosting/CDN).

9.2 Cap. Our aggregate liability arising out of or relating to the Service shall not exceed the amounts paid by you to us for the Service in the twelve (12) months preceding the event giving rise to the claim, or USD 100, whichever is greater.

9.3 Essential basis. These limitations are fundamental elements of the bargain between you and us.

10. Indemnification

You will indemnify, defend, and hold harmless the Company and its affiliates from any claims, damages, liabilities, costs, and expenses arising from: (a) your content; (b) your breach of these Terms; (c) your violation of law; or (d) your misuse of the Service.

11. Suspension & Termination

We may suspend or terminate access if you breach these Terms, misuse the Service, or if required by law or third-party provider changes. Upon termination, your license ends and you must cease use of the Service. Sections intended to survive (e.g., fees, IP, disclaimers, limitations, indemnity, governing law) shall survive.

12. Governing Law; Venue

These Terms are governed by the laws of Poland, without regard to conflict-of-laws rules. The exclusive venue for disputes is the competent court in Warsaw, Poland. You and we waive any objection to such jurisdiction/venue.

13. Export & Sanctions

You represent you are not located in a sanctioned jurisdiction and will not use the Service in violation of applicable export/sanctions laws.

14. Miscellaneous

14.1 Entire agreement. These Terms constitute the entire agreement regarding the Service.

14.2 Severability. If any provision is unenforceable, the remainder remains in effect.

14.3 Assignment. You may not assign these Terms without our prior written consent. We may assign to an affiliate or in connection with a merger/acquisition.
